FAA & DRONE LAWS

Know which rules apply before you launch. This guide explains the U.S. federal framework for recreational flying, Part 107 operations, registration, TRUST, Remote ID, LAANC, altitude, visual line of sight, night operations, restricted airspace, and the role of state and local rules.

First Decision

RECREATIONAL OR
PART 107?

The purpose of the flight matters. The FAA warns that “not getting paid” does not automatically make a flight recreational. If a flight supports work, a business, a service, or another non-recreational purpose, Part 107 is the normal federal rule set for small drones under 55 pounds.

Exception for Limited Recreational Operations

Flying Only for Fun

Recreational flying is a limited exception. To use it, the flight must genuinely be for recreational enjoyment and you must satisfy the conditions of the recreational exception.

  • Pass TRUST before flying and carry proof while operating.
  • Follow the safety guidelines of an FAA-recognized Community-Based Organization.
  • Keep the drone within visual line of sight or use a co-located visual observer as permitted.
  • Stay at or below FAA-authorized altitudes and obtain authorization in controlled airspace when required.

14 CFR Part 107

Work, Business & Most Non-Recreational Flying

Part 107 covers a broad range of commercial, professional, government, and other non-recreational small-drone operations. Examples include real-estate marketing, inspections, paid photography, and many business-support flights.

  • The remote pilot in command normally needs a Part 107 Remote Pilot Certificate.
  • Each drone used under Part 107 must be registered.
  • The remote pilot must keep aeronautical knowledge current.
  • Some operations require airspace authorization, special compliance, or a waiver.

THE RULES EVERY
HOBBY PILOT NEEDS

A lightweight drone is not a rules-free drone. Registration is only one piece of the recreational framework.

TRUST

Take the Free Safety Test

All recreational flyers operating under the recreational exception must pass TRUST and carry proof of passage while flying. The FAA-approved test is free and online.

Registration

250 g Is the Key Recreational Threshold

A recreational drone must be registered if it weighs 250 g (0.55 lb) or more. The exception applies only to eligible lighter aircraft flown exclusively under the recreational exception.

Altitude

400 Feet in Class G

Recreational flyers must stay at or below 400 feet in Class G uncontrolled airspace and at or below FAA-authorized altitudes in controlled airspace.

Authorization May Be Required

Flights in controlled airspace around many airports require prior FAA authorization. LAANC can provide near-real-time authorizations at participating locations.

Aircraft

Yield to Manned Aviation

Drone pilots must give way to and avoid interfering with manned aircraft. A drone operator is responsible for the hazard their operation creates.

Visual Contact

Maintain Visual Line of Sight

Recreational flying includes visual-line-of-sight requirements. FPV goggles do not automatically eliminate the need for a person to maintain the required visual observation.

Check Before Every Flight

Temporary Flight Restrictions, airport airspace, special-use areas, national-security restrictions, parks, and local takeoff rules can change what is legal at a particular site.

The FAA says compensation is not the only test. A flight undertaken to support a business or service may be non-recreational even if no payment changes hands for that specific flight.

Part 107 Core Rules

THE COMMERCIAL
OPERATING BASELINE

Part 107 is detailed, but these are the operating limits and responsibilities a working pilot encounters most often.

400 FEET, VLOS, SAFE OPERATION

The FAA’s current Part 107 overview lists a maximum altitude of 400 feet above ground, with an allowance to operate higher when the drone remains within 400 feet of a structure. Maximum speed is 100 mph (87 knots), and minimum weather visibility is three statute miles from the control station. The remote pilot must avoid manned aircraft, avoid careless or reckless operation, and keep the drone within sight unless operating under an approved rule exception or waiver.

  • A Remote Pilot Certificate with a small UAS rating is normally required to operate the controls, or the person manipulating the controls must be under direct supervision of a certificated remote pilot.
  • Remote pilots must complete recurrent online training within the previous 24 calendar months to maintain aeronautical knowledge currency.
  • Class B, C, D, and certain Class E operations require ATC authorization.
  • Some operations beyond normal Part 107 limits require an FAA waiver.
  • Report qualifying serious injuries, loss of consciousness, or property damage of at least $500 to the FAA within the required timeframe.

Checking airspace should happen before every flight. The right tool depends on whether you are checking situational awareness, requesting near-real-time authorization, or submitting a manual request.

Before Every Flight

A FIVE-MINUTE
LEGAL CHECK

A saved favorite flying spot can become restricted temporarily. Build a short repeatable check into the preflight rather than relying on what was legal last week.

Define the Purpose

Decide whether the flight is genuinely recreational or falls under Part 107 or another operating authority.

Check the Aircraft

Confirm registration, exterior marking, Remote ID status, firmware, lighting, and any category-specific requirements.

Check Airspace

Use current FAA-approved tools for controlled airspace, UAS facility maps, TFRs, security restrictions, and other notices.

Check the Ground

Confirm permission to launch and land and review applicable state, local, tribal, park, privacy, trespass, and property rules.

Verify weather, visibility, people, manned-aircraft activity, emergency operations, obstacles, and a safe return path.

Night Operations

Night flight is possible under Part 107 when the applicable requirements are met. It is not simply a matter of turning on the drone’s navigation LEDs.

PART 107 NIGHT FLIGHT NEEDS ANTI-COLLISION LIGHTING

FAA guidance permits routine Part 107 night operations without a waiver when the remote pilot has completed the required updated initial testing or recurrent training and the aircraft is equipped with anti-collision lighting visible for at least three statute miles with a flash rate sufficient to avoid a collision. Controlled-airspace authorization is still required when applicable.

Restricted & Sensitive Areas

Do not rely on a generic map screenshot. Restrictions can be permanent, temporary, event-driven, or based on the property from which you intend to launch.

TFRs

Temporary Flight Restrictions can appear for VIP movement, emergencies, wildfires, major events, security, and other reasons. Check current FAA information on the day of flight.

Events

Stadium Restrictions

Federal restrictions apply around certain large stadium events, including MLB, NFL, NCAA Division I football, and major motor speedway events during specified windows.

Security

Critical & Sensitive Sites

Some military bases, national landmarks, correctional facilities, critical infrastructure, and national-security locations are subject to special restrictions.

Emergency Response

Do Not Interfere

Drone operations near wildfires, law-enforcement incidents, rescue operations, and emergency aircraft can create serious hazards and may violate active restrictions.

Parks & Property

Launch Rules Can Differ

The FAA regulates the National Airspace System, but land managers and property owners may control takeoff and landing from property under their authority.

Privacy

Airspace Is Not the Only Law

State and local law may regulate privacy, voyeurism, harassment, trespass, photography, land use, and other conduct even where the airspace itself is federally regulated.

FAA APPROVAL IS
NOT THE WHOLE STORY

Federal airspace authority and state or local ground/conduct rules can exist at the same time. A legal airspace route does not automatically give you permission to stand on any property, launch from any park, or record anything you want.

Takeoff and landing restrictions

State, local, tribal, park, and private-property authorities may control use of the ground, including where aircraft may launch or land.

Privacy and surveillance

State and local laws can address privacy, voyeurism, harassment, photography, imaging, and other conduct involving drones.

Trespass and property use

Airspace access does not give a pilot permission to enter private property or use a launch site without authorization.

Local “No Drone Zone” signs

FAA guidance distinguishes local takeoff/landing restrictions from federal airspace restrictions. Check the underlying rule instead of assuming every sign has the same legal effect.

National parks and managed lands

Land-management agencies can impose restrictions on launching, landing, and operating from property they administer even when FAA airspace rules are a separate question.

Check both systems

Use FAA tools for airspace and separately check the rules of the property owner, park, city, state, tribal government, or other authority controlling the launch location.

Do I need a license to fly a drone for fun?

You do not need a Part 107 Remote Pilot Certificate for a qualifying recreational flight, but you must pass TRUST and comply with the recreational exception’s requirements.

Do I need to register a drone under 250 g?

An eligible drone under 250 g may avoid recreational registration only when flown exclusively under the recreational exception. Drones flown under Part 107 must be registered regardless of that recreational weight exception.

Can I fly up to 400 feet anywhere?

No. The 400-foot limit does not override controlled-airspace authorization, TFRs, security restrictions, local ground rules, or other location-specific requirements.

Can I fly near an airport?

Possibly, but flights in controlled airspace near airports require prior FAA authorization. LAANC provides near-real-time authorization at participating airports within approved parameters.

Can I fly at night under Part 107?

Yes when the applicable FAA requirements are met, including current qualifying pilot training and anti-collision lighting visible for at least three statute miles. Controlled-airspace authorization may still be required.

Do local governments have authority over drones?

Yes in important areas. The FAA regulates the National Airspace System, while state and local authorities may regulate areas such as land use, takeoff and landing, privacy, trespass, harassment, and other conduct subject to federal preemption principles.

Does FPV let me fly beyond visual line of sight?

No. Wearing goggles does not by itself authorize beyond-visual-line-of-sight flight. Part 107 BVLOS operations generally require appropriate FAA authority, and recreational flying remains subject to visual-line-of-sight requirements.

Where should I check immediately before flying?

Use current FAA-approved B4UFLY resources for situational awareness, LAANC when authorization is available and needed, and FAA sources for TFRs, DroneZone, registration, and Remote ID.
